These Terms and Conditions ("Terms") govern your use of DreamWed's website and destination wedding planning services. By engaging our services or using our website, you agree to be bound by these Terms. DreamWed is a registered Ontario travel agency, TICO Registration #50019593.

1. Service Agreement

DreamWed provides destination wedding planning services including, but not limited to, venue sourcing, resort bookings, travel coordination, vendor management, and on-site event coordination. Our services commence upon receipt of a signed service agreement and initial deposit.

A formal written agreement will outline the specific services, timeline, fees, and responsibilities for your wedding. These Terms supplement that agreement. In the event of any conflict between these Terms and your individual service agreement, the service agreement will prevail.

2. Booking & Reservations

All bookings for resorts, travel, and vendor services are subject to availability at the time of reservation. DreamWed acts as an intermediary between you and third-party service providers. While we use best efforts to secure your preferred arrangements, we cannot guarantee availability or pricing until a booking is confirmed and paid.

You are responsible for ensuring that all travel documents (passports, visas, etc.) are valid and current. DreamWed is not liable for denied boarding or entry due to invalid travel documents.

3. Payments

Payment terms are outlined in your individual service agreement. Generally, our payment structure includes:

• Retainer fee: A non-refundable retainer is due upon signing the service agreement to secure your wedding date
• Progress payments: Additional payments are due at specified milestones
• Final payment: The remaining balance is due 60 days before the wedding date

Resort and travel bookings may require separate payments directly to the providers, subject to their individual payment terms and conditions.

4. Cancellation & Refund Policy

Cancellation policies vary depending on the services booked and the timing of cancellation:

• More than 180 days before the wedding: Full refund less the non-refundable retainer and any non-recoverable third-party costs
• 90 to 180 days before: 50% refund of DreamWed planning fees, subject to third-party cancellation penalties
• Less than 90 days before: No refund of DreamWed planning fees. Third-party refunds subject to each provider's cancellation policy

In the event of cancellation due to circumstances beyond your control (such as government travel advisories, natural disasters, or pandemic restrictions), DreamWed will work with you to reschedule or obtain maximum possible refunds from third-party providers.

5. Limitation of Liability

DreamWed acts as an agent in arranging services provided by third parties including resorts, airlines, ground transportation, and local vendors. We are not liable for:

• Acts, omissions, or defaults of third-party service providers
• Flight delays, cancellations, or schedule changes by airlines
• Changes in resort policies, amenities, or conditions
• Weather conditions or natural events affecting your wedding
• Loss, theft, or damage to personal property during travel
• Injury, illness, or death resulting from activities at the destination

DreamWed's total liability in any claim arising from our services shall not exceed the total planning fees paid to DreamWed under your service agreement.

6. Travel Insurance

We strongly recommend that all clients and their guests purchase comprehensive travel insurance covering trip cancellation, medical emergencies, travel delays, and lost luggage. DreamWed can recommend insurance providers but is not responsible for any claims or coverage decisions.

7. Intellectual Property

All content on the DreamWed website, including text, images, logos, graphics, and design elements, is the property of DreamWed and is protected by Canadian and international copyright laws. You may not reproduce, distribute, or use any content without our prior written consent.

8. TICO Registration

DreamWed is registered with the Travel Industry Council of Ontario (TICO), Registration #50019593. As a TICO registrant, we comply with the Ontario Travel Industry Act and its regulations. Clients are protected by the Ontario Travel Industry Compensation Fund for eligible claims. For more information about TICO and your consumer rights, visit www.tico.ca.

9. Governing Law

These Terms are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any disputes arising from these Terms or our services shall be resolved through the courts of Ontario, Canada.

10. Changes to These Terms

DreamWed reserves the right to modify these Terms at any time. Changes will be posted on this page with an updated revision date. Continued use of our website or services after changes constitutes acceptance of the revised Terms.
